Jayne Anthony Garden Design - Contract Terms and Conditions

Any changes to the design brief after design work has started will be subject to additional charges as per the hourly rate specified.

If at any time, you wish to terminate this agreement, payment is due up to and including the work completed to date.

If no communication is received after presentation of a design, design fees will be payable no later than 6 weeks from the last communication.

The fees quoted are fixed upon acceptance of the proposal. The fees are payable in stages as set out. Invoices must be paid within 7 days of receipt. The fees quoted are valid for 28 days from date of proposal.

You will be responsible for the arrangement of any planning permission or licences in respect of the works, obtaining information on site ownership and boundaries and making the necessary checks that any trees which require remedial work or removal are subject to a protection order.

I am the owner of all intellectual property rights of the design. You may use the design for the location as set out in the proposal but for no other purpose. You may not allow a third party to use the design nor implement the design at a different location, without prior consent from myself.

I will endeavour to comply with any specific delivery dates of the service, but no such dates are guaranteed.

I may assist you in communicating with third parties but it is your responsibility to contract directly with third parties to carry out the work. I will not be responsible for the work undertaken by third parties, the manner in which the works are carried out or any other aspects of their progress.

Project monitoring, if required, means that I will conduct site inspections at appropriate intervals of the construction as agreed prior to the start of the works. I shall notify you of any discrepancies that I have noted between the design and the actual works being delivered in order that you may take steps to rectify such changes as you see fit.

The plants will be obtained at a trade price and as such the plants are not guaranteed. However I will only source from a reputable supplier and will ensure that only healthy stock is used. Varieties may change depending on availability.

Jayne's ideas of how to transform a long straight garden into something more interesting were quite inspirational. By introducing shape and perspective the garden now has structure.
